These Terms do not govern the terms of any separate construction, restoration, renovation, design, consulting, or other service agreement you may enter into with Douglas Homes. Any proposal, estimate, work order, change order, or signed project agreement between you and Douglas Homes will control with respect to those services in the event of a conflict with these Terms.

3. Use of the Site

You agree to use the Site only for lawful purposes. You may not:

  • use the Site in any way that violates any applicable law, regulation, or third-party right;

  • attempt to gain unauthorized access to the Site, its servers, or related systems;

  • interfere with or disrupt the operation or security of the Site;

  • introduce malicious code, viruses, bots, scraping tools, or other harmful technology;

  • use the Site to transmit spam, misleading inquiries, or fraudulent requests;

  • copy, reproduce, republish, distribute, or exploit Site content except as expressly permitted by these Terms or by law.

We reserve the right to suspend, restrict, or terminate access to the Site at any time, with or without notice, if we believe a user has violated these Terms or used the Site improperly.

4. Information Submitted Through the Site

If you submit information through the Site, including through a contact form, consultation request, estimate request, phone inquiry, email inquiry, or similar feature, you represent that:

  • the information you provide is truthful, current, and accurate;

  • you have the right to provide that information;

  • you will not provide information that is false, misleading, defamatory, unlawful, or infringing;

  • any property or project information you provide is submitted voluntarily for business, communication, and evaluation purposes.

You are responsible for the content of any message, file, image, or other material you submit to us through the Site.

5. No Guaranteed Response, Availability, or Results

The Site is provided for general informational and communication purposes only.

Submission of an inquiry, consultation request, or other form through the Site does not guarantee:

  • acceptance of a project;

  • availability of services in your area;

  • scheduling within a particular timeframe;

  • a response within any specific time period;

  • a quote, estimate, or proposal;

  • a specific outcome, project result, or business result.

Any timelines, project descriptions, examples, testimonials, service descriptions, or other content on the Site are for general informational purposes only and do not create a binding promise or warranty.

6. Estimates, Proposals, and Project Information

Any pricing, ranges, project descriptions, conceptual information, examples, renderings, estimates, or preliminary recommendations shared through the Site or in response to an online inquiry are informational only unless included in a separate written agreement signed by Douglas Homes.

A submitted inquiry or consultation request does not create a contractor-client, builder-client, or consultant-client relationship until the parties have entered into a separate written agreement, if any.

7. Intellectual Property

All content on the Site, including text, graphics, images, logos, branding, layout, design, software, downloads, and other materials, is owned by Douglas Homes or its licensors and is protected by intellectual property and other applicable laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial use.

You may not, without our prior written consent:

  • reproduce, modify, distribute, display, publish, sell, license, or create derivative works from Site content;

  • use our name, logo, or branding in a misleading or unauthorized way;

  • frame or mirror any portion of the Site.

8. User Feedback and Submissions

If you send us feedback, suggestions, ideas, reviews, comments, or other submissions regarding the Site or our services, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, and display that content for business purposes, subject to applicable law and our Privacy Policy.

You represent that you have the right to provide any such submission.

9. Communications

DOUGLAS HOMES DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

We do not warrant that the Site content is complete, current, or suitable for your specific circumstances.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DOUGLAS HOMES AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF DOUGLAS HOMES FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

14. Indemnification

You agree to defend, indemnify, and hold harmless Douglas Homes and its owners, officers, employees, contractors, affiliates, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

  • your violation of these Terms;

  • your violation of any law or third-party right; or

  • any information or materials you submit through the Site.

15. Geographic Scope

The Site is controlled and operated from the United States. We make no representation that the Site is appropriate or available for use in all locations. If you access the Site from outside the United States, you do so at your own initiative and are responsible for compliance with local laws.

16. Governing Law and Venue

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Douglas Homes regarding your use of the Site, except for any separate written agreement relating to actual services or projects.
